Liability and Warranty
In no event shall we be liable for any damages including, but not limited to any damages or losses arising from the use or inability to use our services. Our services are provided “as is” without warranty of any kind, for example we give no warranty that you website will be up 100% of the time, however we endeavour to use partners that offer in excess of 99% uptime guarantees.
Content on our hosting
We and our partners cannot be held responsible for content added to your website. You agree that you are responsible for all content you add to your website, and for any litigation made against you. If a copyright complaint is made against a website, we hold the right to request content to be removed and/or suspend/terminate the hosting service. You may only upload content that you have the rights or a valid license to.
All accounts have file space and bandwidth limits. If you go over these limits in any given month, we will contact you to discuss options, this can include upgrading your account to a higher tier or taking steps to reduce the amount of file space or bandwidth been used. If you constantly go over the limits, we hold the right to terminate your service.
We may terminate your hosting at any time if any illegal activity is taking place. We may also terminate your account if payments are not kept up to date, although we will try to contact you prior to this happening.
Payments are to be made within 14 days of an invoice been issued, payments are normally required for 6 months in advance, however this will be decided externally through the contract you sign.
You can cancel your service at any time, however you will not be refunded for any time left on your account. If you would like a download of your website files and a copy of the database SQL so you can move your site to another hosting provider, or you would like us to move the website for you then additional charges will apply based on the time it takes to perform this and the hourly rate we charge, you will be quoted for this process prior to any work starting.
Backups of your website are made daily. This will ensure that if there is a problem with your website then we can revert back to an earlier version. We only keep the last 5 backups on file for each website.
